This is a divorce case where parties contested the value of the matrimonial assets, namely, the value of a company held by the Husband.

Each party tendered an expert valuation (where the Husband’s value was lower, and the Wife’s value was higher) before the Court. The Judge had to decide whose valuation report was more appropriate as each expert had used a different valuation method. Eventually the Judge decided on a figure which was mid-point between what the parties had submitted on and divided the matrimonial assets accordingly.

Summary: In complex cases involving the valuation of matrimonial assets, the Court will take an independent view of the experts’ reports in arriving at a just and equitable value of the asset.
