This was a case where after divorce, the Father was granted care and control of the Children. The Mother got into an argument with him, and the Father chased her out of the house.

The Mother then left the house with the children. Thereafter, she sought care and control of the children. The Court refused to sanction her behaviour and ordered that the children be returned to the Father’s care and control within two weeks of the order.

Summary: In child abduction cases, the Court will be slow to retrospectively allow the application of the offending parent to retain the child, especially if there is an existing court order stating otherwise.
